I was contacted by a company recruiter for a full time PA position however the pay was quite low for the current market. I told him if this was a 1099 independent contractor position with NO benefits then I would require a higher pay especially since 1099 contractors have to pay a higher tax rate since the employer doesn't. The recruiter talked to someone and came back to be with a little higher of an offer but still too low for a 1099 position. I was given an offer letter which was really short just stating simple things like the days of the week to work (Mon-Fri), hours, daily pay rate. Later on I received an email for the actual Independent Contractor Agreement (contract) and the entire contract reads like a W-2 employee, NOT an independent contractor. I told them this wasn't a legal contact according to the department of labor and that it would need to be revised to be a legal contract. There is information from government websites out there to view that explains the difference between a 1099 and W-2 employee. They then told me they were going to withdraw the contract to have their lawyers review it. After waiting about a week, I was contacted by a man I had never spoke to before and he told me their legal counsel said the contract was still okay to use however they were going to withdraw it from me. I tried to see if they would be willing to negotiate the contract however the man became very rude trying to tell me I "wasn't going to be a good fit for the veterans." I said "our veterans?! You mean the ones that fought for my freedom and my rights to have a proper legal job?" This is a huge employee misclassification lawsuit waiting to happen. The current employees really need to take action. I can't believe a company that has been around this long has been getting away with scamming their employees. The job posting for this position has been posted up for a very long time.
